Listed below are the latest Terms of Agreement. If changes are made after an Affiliate has signed up, they will be
notified by email of the change. Please review these terms before you apply to become an Affiliate.
In this agreement, the term "Affiliate" refers to you (the applicant). Wherever the agreement refers to "you" or "your", it
means "the Affiliate". References to "we" or "our" refers to Birthcare. Thank you.
Affiliate's Responsibilities
- You, as the Affiliate, agree to post the link in the manner in which it was intended: to make people aware of the
Birthcare website and/or our products.
- You can freely change the description of the text link to suit its placement in your web page, email message or other
source; however, the description must convey the fact that they will be taken to the Birthcare web site or a page
dealing with the subject matter of our products.
- Any attempt to mislead anyone into clicking the link will result in the termination of this agreement.
- Any unsolicited mass emailing (SPAM), newsgroup posting or other violations of sevices beyond their intended use, policies
or "netiquette" will result in the termination of this agreement.
- If you have not met the minimum payment of $20 within 6 months, your affiliation will be terminated with payment of your balanced owed.
- It is your responsibility to provide us with accurate information regarding yourself in order that payment can be made.
- You agree not to associate your unique link with adult web sites or disreputable or immoral web sites.
- Any attempt to defraud our tracking system will result in termination of this agreement.
Birthcare's Responsibilities
- We agree to provide you with your unique link (URL) as a means of tracking the sales you bring to our site.
- We are responsible for tracking and auditing purchases made on our site through your link.
- We agree to provide you with an on-line statistical report.
- We agree to pay 8% (less shipping and taxes) per item sold through your assigned link. Within thirty (30) days after the end of each calendar month during the term of this agreement, Birthcare shall pay you a referral fee for all sales generated from your site. Referral fees less than $20 will be carried over to following months until such referral fees reach $20.
- If an order that generated a referral fee is returned by the customer, or if there are any returned checks or chargebacks, the amount will be deducted from the next monthly payment. If the next months sales do not cover the deducted amount an invoice will be issued to the Affiliate.
- It is our sole discretion to terminate this agreement based on use that would damage the reputation or credibility of Birthcare.
Limitation of Liability
In no event shall Birthcare be liable to the Affiliate for any direct, indirect, special, exemplary, consequential or incidental damages arising out of or in connection with this Agreement or the Program, even if informed of the possibility of such damages. Birthcare's aggregate liability arising with respect to this Agreement and the Program will not exceed the total commission fees paid or payable to Affiliate under this Agreement.

Birthcare makes no express or implied warranties or representations with respect to the Affiliate Program or your potential to earn income from the Affiliate Program. In addition, we make no representation that the operation of our site or the Affiliate Sites will be uninterrupted or error-free, and we will not be liable for the consequences of any interruptions or errors.
By submitting the Affiliate Order form, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this agreement.
